Terms of Service

YOBY’s Terms of Service explain how families, children, schools and partners can use our safe digital world for playful financial education.

Terms of Service

Last updated: July, 7th 2026

Welcome to YOBY.

These Terms of Service explain the rules for using YOBY, our website, our digital family pond, our games, quests, learning activities and related services.

YOBY is built for families, children, schools and better money habits. We try to keep these Terms clear, because nobody should need a torch, a helmet and three wise moles to understand how a children’s app works.

By creating an account, using YOBY or allowing your child to use YOBY, you agree to these Terms.

1. Who we are

YOBY is operated by:

YOBY
Contact email:

stefano@yoby.fun

In these Terms, “YOBY”, “we”, “us” and “our” refer to the operator of the YOBY service.

2. What YOBY is

YOBY is a digital world where children and parents explore ponds, meet mentor characters, complete quests and build healthier financial habits together.

YOBY includes playful educational activities about money, choices, saving, goals, waiting, value, negotiation and family conversations.

YOBY is not a bank.
YOBY is not an investment platform.
YOBY does not provide financial, legal, tax or investment advice.

The ducks may talk about money. They do not manage your portfolio.

3. Who can use YOBY

YOBY is designed for families and children, but children must use YOBY under the responsibility of a parent or legal guardian.

A parent or guardian must create and manage the family account. The parent or guardian is responsible for inviting children, managing access, supervising use and making sure that YOBY is appropriate for the child.

Children cannot create an open public account by themselves.

By creating a family account, you confirm that:

  • you are at least 18 years old, or the age of legal majority in your country
  • you are the parent, legal guardian or authorised adult responsible for the child users you invite
  • the information you provide is accurate
  • you will keep your login details secure
  • you will use YOBY in accordance with these Terms

4. Family accounts and family ponds

YOBY is built around the family pond.

The family pond is a private digital space where invited family members can explore, complete quests and progress together.

As the parent or guardian account holder, you can invite family members, manage child profiles, set or change parental controls, restrict access to certain areas, remove users and close the family pond.

You are responsible for all activity that takes place through your account, unless the activity results from our own security failure.

Keep your password safe. A password left wandering around the reeds is rarely a good idea.

5. Child safety

YOBY is designed to be safe by design.

We may use safety features such as invite-only access, parental controls, automatic content filtering, restricted communication features, age-appropriate experiences and moderation tools.

Children cannot be contacted by strangers through YOBY.
Video or chat features may be restricted or unavailable unless a parent or authorised adult is present.
We may suspend or remove accounts that violate safety rules or create risk for children or families.

Safety features are designed to reduce risk, but no digital service can guarantee that every risk is impossible. Parents and guardians remain responsible for supervising children’s use of YOBY.

6. Acceptable use

You agree not to use YOBY in a way that harms the service, other users or children.

You must not:

  • contact, attempt to contact or interact with children outside authorised family or school spaces
  • upload, send or share inappropriate, harmful, offensive, sexual, violent, abusive or illegal content
  • impersonate another person
  • create fake accounts
  • attempt to bypass parental controls or safety systems
  • harass, threaten, exploit or manipulate other users
  • reverse engineer, scrape, copy or attack the service
  • use bots, automated systems or scripts without our permission
  • interfere with the security or availability of YOBY
  • use YOBY for advertising, spam or commercial solicitation without our written consent
  • use YOBY for illegal purposes

If you break these rules, we may limit, suspend or terminate your account.

7. Educational content

YOBY provides educational and playful content.

The content is designed to help families talk about money and build better habits, but it is not professional advice.

Any examples, quests, simulations, symbolic currencies, progress indicators, goals or learning prompts are for educational purposes only.

You should not rely on YOBY as a substitute for advice from a qualified financial, legal, tax or educational professional.

YOBY teaches children how to think about choices. It does not tell families what financial decisions to make.

8. AI and mentor characters

YOBY may include AI-supported mentor characters, assistants, quests, explanations or recommendations.

These features are intended to support learning and family discussion. They may generate imperfect, incomplete or unexpected responses.

You should not treat AI-generated content as professional advice or as the final answer to a financial, legal, tax, medical, educational or safety question.

We may monitor, filter, moderate or restrict AI interactions to protect children and improve safety.

9. Symbolic items and game economy

YOBY may include symbolic items such as shells, seeds, stars, collectibles, avatars, fragments, pond decorations and other in-game elements.

These items are part of the YOBY learning experience.

Unless we clearly state otherwise, symbolic items:

  • have no real-world cash value
  • cannot be exchanged for money
  • cannot be sold or transferred outside YOBY
  • remain subject to changes in the product
  • may be modified, removed or reset if needed for technical, safety or product reasons

Please do not build an underground duck stock exchange. The Mole will know.

10. Subscriptions and paid plans

YOBY may offer free and paid plans.

The features, limits and prices of each plan are shown on the website, in the app or at checkout. We may update plans, prices and features from time to time.

If you subscribe to a paid plan, you agree to pay the applicable fees and any taxes shown at checkout.

Subscriptions may renew automatically unless cancelled before the renewal date.

You can cancel your subscription at any time through your account settings, the payment provider, the app store or by contacting us, depending on where you subscribed.

Cancelling a subscription stops future renewals. It does not automatically refund past payments unless required by law or clearly stated by us.

11. Free trials and promotional offers

We may offer free trials, discounts or promotional access.

The specific conditions of each offer will be shown when the offer is made.

We may limit, change or withdraw promotional offers at any time, provided this does not affect rights you already have under an active offer.

At the end of a free trial, a paid subscription may begin only if this was clearly explained and you provided the required payment authorisation.

12. Right of withdrawal and refunds

If you are a consumer in the European Economic Area, the United Kingdom or another country with mandatory consumer protection laws, you may have statutory rights, including a right of withdrawal or cancellation.

Where applicable, consumers in the European Union generally have a 14-day right of withdrawal for distance contracts, subject to specific rules and exceptions for digital services and digital content.

If you request immediate access to digital services or content during the withdrawal period, your right of withdrawal may be affected according to applicable law and the choices presented at checkout.

Nothing in these Terms limits mandatory consumer rights that cannot be excluded by law.

For refund requests, contact us.

13. Payments

Payments may be handled by third-party payment providers, such as Stripe, Apple, Google or other providers.

Payment providers may have their own terms, privacy notices and refund processes.

We do not store full payment card details on our servers.

You are responsible for keeping payment information accurate and up to date.

14. Schools, banks and partner programmes

YOBY may be offered through schools, banks, foundations, municipalities or other partners.

When YOBY is used through a school or partner programme, additional terms may apply. These may include specific access rules, pilot conditions, data processing terms, classroom supervision rules or partner-specific limitations.

If there is a conflict between these Terms and a signed agreement with a school or partner, the signed agreement will apply to that specific programme, unless mandatory law says otherwise.

15. User content

YOBY may allow users to create or share limited content, such as names, avatars, messages, family goals, quest answers, drawings, decorations or other interactions.

You keep ownership of the content you create, where applicable.

By using YOBY, you give us the right to host, store, display, process and use that content as needed to provide the service, protect users, improve the product and comply with the law.

You must not upload or share content that you do not have the right to use.

We may remove content that violates these Terms, creates risk or is not appropriate for YOBY.

16. Intellectual property

YOBY, including its name, characters, duck avatars, mentor characters, ponds, worlds, graphics, text, software, design, quests, game systems and visual identity, belongs to YOBY or its licensors.

You may use YOBY only as allowed by these Terms.

You may not copy, modify, distribute, sell, reverse engineer, reproduce or create derivative works from YOBY without our written permission, except where allowed by law.

The ducks are friendly. They are not open-source ducks unless we explicitly say so.

17. Feedback

If you send us ideas, suggestions, bug reports, feature requests or feedback, you allow us to use them to improve YOBY without owing you compensation.

We appreciate feedback. It helps the pond grow reeds in the right places.

18. Service availability

We try to keep YOBY available and working well.

However, we may need to interrupt, update, change or suspend the service for maintenance, security, technical problems, product changes or reasons beyond our control.

We do not guarantee that YOBY will always be available, error-free or compatible with every device or browser.

19. Changes to YOBY

YOBY is a growing product.

We may add, change, limit or remove features, characters, quests, items, plans or parts of the world.

If a change materially affects a paid subscription, we will provide notice where required by law.

We will try not to move the whole pond overnight without telling the ducks.

20. Account suspension and termination

We may suspend or terminate your account if:

  • you violate these Terms
  • you create safety risks
  • you misuse the service
  • payment fails and is not resolved
  • we are required to do so by law
  • we need to protect children, families, YOBY or other users

You may stop using YOBY at any time.

You may request deletion of your account and family data as described in our Privacy Policy.

Some information may be retained where required for legal, accounting, fraud prevention, security or dispute purposes.

21. Privacy

Our Privacy Policy explains how we collect, use, protect and delete personal data.

By using YOBY, you also agree that we may process personal data as described in our Privacy Policy.

For privacy questions, contact:

privacy@yoby.fun

YOBY may include links or integrations with third-party services, such as payment providers, login providers, app stores, hosting providers, analytics tools or partner services.

We are not responsible for third-party websites, services, content or policies.

Your use of third-party services may be subject to their own terms and privacy notices.

23. Beta features and pilots

Some parts of YOBY may be released as beta, preview, pilot or experimental features.

Beta features may change, break, disappear, behave strangely or occasionally flap into a bush.

We may limit access to beta features or remove them at any time.

If you participate in a school, bank or partner pilot, specific pilot terms may apply.

24. Disclaimers

YOBY is provided on an “as is” and “as available” basis, to the maximum extent permitted by law.

We do not promise that:

  • YOBY will meet every need or expectation
  • every child will achieve a specific educational result
  • the service will always be available or error-free
  • all content will always be accurate, complete or suitable for every situation
  • AI-supported features will always produce perfect responses

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law.

25. Limitation of liability

To the maximum extent permitted by law, YOBY will not be liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, goodwill or business opportunities.

Our total liability for claims related to YOBY will be limited to the amount you paid to YOBY in the 12 months before the claim, unless mandatory law requires a different rule.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, intentional misconduct or any liability that cannot be limited by law.

26. Indemnity

If you use YOBY in violation of these Terms or the law, you agree to be responsible for claims, damages, losses and costs arising from that misuse, to the extent permitted by law.

This section does not apply where prohibited by consumer protection law.

27. Governing law

These Terms are governed by the laws of Italy, without prejudice to mandatory consumer protection laws that may apply in your country of residence.

If you are a consumer, you may have the right to bring claims in the courts of your country of residence, where mandatory law provides this right.

For business users, schools, banks or partners, disputes will be handled by the courts of Italy, Catania(CT), unless a separate written agreement states otherwise.

28. Consumer complaints and alternative dispute resolution

If you have a complaint, please contact us first at:

stefano@yoby.fun

We will try to resolve the issue fairly and quickly.

Where required by law, you may also have access to consumer protection authorities or alternative dispute resolution bodies in your country.

The former EU Online Dispute Resolution platform has been discontinued as of 20 July 2025, so I would not add the old ODR link that many legacy templates still include.

29. Changes to these Terms

We may update these Terms from time to time.

If changes are important, we will notify users through the website, email or inside the service.

The updated Terms will show the latest revision date.

If you continue using YOBY after the updated Terms take effect, you accept the updated Terms.
